Article 1. ACCEPTANCE OF THE TERMS

 

Welcome to RPGSTORIES.net (Hereinafter: “Website”), a website about RPG Stories, an online Virtual Table Top 3D Worldbuilding software that enables the user (Hereinafter: “User”) to make high-quality content and play online with other users (hereinafter: “Software”). On RPGSTORIES.net the User can buy products related to TT RPGs and other software and video games.

These terms of use (hereinafter: “Terms of Use”) are provided by Brave Alice LTD, with a registered office at 5 Camborne Avenue, London, England, W13 9QY, and with company registration number 14141355. (Hereinafter: “Brave Alice, “we”, “us” or “our”) will apply to the access and use of the website. Please read these Terms of Use carefully before accessing and using our website and services.

In order to access or use the website, the User represents that he/she has the legal authority and legal capacity to accept these Terms of Use. If the User is under the age of 16, they cannot access, or use the website without parental consent.

These Terms of Use constitute a legally binding agreement between the User and Brave Alice in relation to the website. Any use of the website must always be done in accordance with all applicable legislation and in a safe and secure manner.

 

Article 2. SUBSCRIPTION

 

Each user has the right to subscribe for free to our website in order to receive newsletters, offers, and updates via email about RPG Stories.

 

Article 3. PAYMENTS

 

3.1. Donation: Any user has the right to donate an amount of money of his/her choice through the designated section on our website to contribute to the completion of the software release.

 

3.2 Buy a product: The User can proceed to a payment in order to buy a digital product. Brave Alice LTD will not be liable for any damages of any kind arising from the use of this site, including, but not limited to indirect or consequential damages which derive from the direction of the User to other sites.

 

 

3.3. The method of payment on the website is either through PayPal or by credit card.  We do not capture or store your credit card details, only the authority from our bank that your credit card payment has been approved.

We accept Visa, Mastercard, and American Express cards via a secure payments system that is linked directly to our bank, which will authorize all credit card payments.

3.4. If a user is under 18 years old, they need parental approval to use any of our services or to purchase any of our products.

 

3.5. If you donate online or if you choose to buy a product, you will receive an acknowledgment of your donation from us via email, within 24 hours. If you donate online through one of our fundraising partners a receipt will be generated according to their terms and conditions.

 

By donating or buying from this website, you are agreeing to our terms and conditions including our refund policy. Please review the following prior to making your payment.

 

Article 4. REFUNDS

 

 We recognize that it is possible to make an error when making an online transaction or for donors to change their minds about the donation made. It can also occur that an error can be made by our website or our financial institution. The website will fully examine all requests for refund and endeavor to ensure that genuine errors are rectified, however, we are under no obligation to give refunds and the decision on refunds will be at the website’s discretion. We will never proceed to a refund if the User buys a product from another site even if he/she was directed to this site following a link in RPGSTORIES.net.

 

Article 5. LIABILITY

 

 5.1. The liability of Brave Alice, its affiliates, its or their officers, employees, directors, shareholders, subsidiaries, or agents shall - at all times - be limited to the mandatory liability under the law taking into account the factual circumstances.

 

 5.2. Brave Alice assumes no liability or responsibility for any (a) errors, mistakes or inaccuracies of content or confidentiality; (b) personal injury or property damage, of any nature whatsoever, resulting from the access to the use of the website of Brave Alice; (c) any unauthorized access to or use of the servers of Brave Alice and/or any and all personal information and/or financial information stored therein (including any and all User submissions); (d) any bugs, viruses, Trojan horses, etc. which may be transmitted to or through the website or any other product of Brave Alice by any third party; and/or any infringement by its Users of the intellectual property rights of third parties and/or other Users (e) for any loss or damage of any kind incurred as a result of the use of any content posted, e-mailed, transmitted or otherwise made available on or through the website, unless in the event of a serious or deliberate error attributed to Brave Alice with regard to the fulfilment of its obligations;

 

 5.3. The liability of Brave Alice shall, in any case, be limited to direct damage arising from the shortcomings and be subject to a maximum liability to the amount of the invoice and/or the amount that the insurance company of Brave Alice will pay out in such case, whichever is the lowest.

 

 5.4. Under no circumstances shall Brave Alice be liable for indirect or consequential damages (including, but not limited to damages for loss of revenue, profits, goodwill, use, data, or other intangible losses).

 

 5.5. The User is solely responsible and liable for the content that he/she creates using the website. The User shall indemnify and hold Brave Alice harmless for any and all claims from third parties regarding any content created by the User.

 

Article 6. FORCE MAJEURE AND HARDSHIP

 

 6.1. In case of force majeure or unforeseen circumstances (Hereinafter: “Force Majeure”), Brave Alice shall, after notifying the User, have the right to cancel all or part of any obligations or to suspend their performance, without being liable for any compensation.

 

 6.2. Without being exhaustive, the following circumstances will be construed as cases of Force Majeure (and/or hardship): Technical problems encountered due to cyberattacks, strikes, lock-outs, acts of war, riots, fire, orders, regulations, or instructions from any governmental or administrative authority, errors or delays attributable to third parties, pandemics and/or epidemics.

 

​Article 7. INTELLECTUAL PROPERTY

 

 7.1. Unless otherwise agreed in writing, all intellectual property rights, including, copyrights, patent rights, trademarks, designs, know-how, concepts, images, drawings, (test) models, brands, logo’s, software, etc. that are provided, whether registered or not, are the property of Brave Alice (hereinafter: “Intellectual Property Rights”).

 

All information, oral or written, provided by Brave Alice to the User shall remain the property of Brave Alice, and the User may only use the information for the purpose for which it was provided. The User shall not provide the information received from Brave Alice to third parties, in any manner whatsoever, except insofar as may be reasonably necessary, and if so, only after and insofar as an obligation of confidentiality has been agreed.

 7.2. No single element of these Terms of Use may be construed as a transfer of these Intellectual Property Rights.

 

 7.3. The User must abide by all copyright notices, trademark notices, information, and restrictions contained in or associated with any content on the website or mobile application of Brave Alice. The User agrees to not remove, alter, interfere with, or circumvent any copyright, trademark or other proprietary notices marked on the website or any digital rights management mechanism, device, or other content protection or access control measure associated with the website of Brave Alice.

 

​Article 8. CHANGES

 

 Brave Alice may unilaterally decide to change, remove or add clauses to the Terms of Use. When the Terms of Use are modified, they shall be uploaded and marked with the revision date.

If the modifications are material, reasonable efforts will be made to notify the User of the material modifications.

Unless otherwise specified, all revised, modified new Terms of Use shall take effect immediately and are applicable to the website, except material changes which shall take effect 10 calendar days from the date of notification.

In our marketplace User’s products will also be available. In the latter case the following will be applied:

 

-Intellectual property rights will belong to its author.

-Following the sale of the product Brave Alice assumes no liability or responsibility in case someone steals his/her intellectual property.

-Brave Alice assumes no liability or responsibility if the content of a product is stolen.

-If said User has bought the pledge “story teller” we will keep only the taxes out of his/her sales.

--If said User has bought the pledge “VIP Member” we will keep the taxes plus 20% of his/her sales.

-On any other occasion we will keep the taxes plus 30% of his/her sales.

-Payments from Brave Alice will be materialised through paypal or bank deposite every 3 months, starting from the date his/her product will be uploaded on our site.

-A more specific agreement is always available should the Parties will decide to do so.

-Brave Alice has the right to turn down a product or remove it at anytime.

-Brave Alice has the right to review a product before it will be uploaded on the site.

 

Article 9. MISCELLANEOUS

 

 9.1. If one or more provisions are found to be invalid, illegal, or unenforceable, in whole or in part, the remainder of that provision and of this Agreement shall not be affected and shall continue in full force and effect. In such event, the Parties shall in good faith amend the invalid, illegal or unenforceable provision(s) or any part thereof and/or agree on a new provision in such a way as to reflect insofar as possible the purpose of the invalid, illegal or unenforceable provision(s).

 

 9.2. All disputes concerning this Agreement shall be governed by English law. The courts of England shall have exclusive competence over said disputes.

Refund Policy

You may ask for a refund only in the following cases:

 

  1. If you download a product and files are missing. In that case, you may request a refund or request for the missing files.

  2. If any purchased software is not working.

  3. In case you purchase any product and you cannot download it after you paid.

  4. You may ask for a refund in case you pre-order a product and we do not provide it within 12 months, at least in an early version.

  5. You may ask for a refund in case you accidentally purchase a product more than once.

 

In all cases, you will have to prove you purchased the said product from our website www.rpgstories.net
